Ieri un amico architetto mi ha raccontato un'avventura per così chiamarla davvero grottesca e surreale. Tutto è iniziato due sere prima, quando l'amico libero professionista rientrato a casa dopo il lavoro ha trovato sulla porta un avviso del messo comunale che gli chiedeva di presentarsi in Comune al più presto per comunicazioni che lo riguardavano. Data l'ora, l'architetto non avendo la possibilità di chiamare il Comune ha trascorso la serata nell'ansia che attanaglia gli onesti e puri quando si vedono recapitare "inviti" del genere: "cosa avrò fatto?".

La mattina seguente ha telefonato in Comune e non ha potuto saper nulla dell'atto che doveva essergli notificato in quanto, per la privacy, non era possibile dare certe informazioni al telefono (giustamente). L'archietto lavora a circa 20 Km da dove abita ed essendo ormai in ufficio, e visti gli orari del Comune, ha preso appuntamento per il giorno successivo con il funzionario. Pertanto la mattina dopo, passata un'altra notte d'ansia, si è recato agli uffici comunali e dopo la canonica attesa di mezz'ora (nonostante l'appuntamento appositamente fissato) ha verificato che, innanzitutto, per la privacy, l'incartamento che lo riguardava era ben leggibile e libero da vincoli sulla scrivania del messo, sguarnito di qualsivoglia tutela. Vabbè, sorvolando sul dettaglio della privacy, la bella notizia contenuta nell'atto, rivelatosi cartella esattoriale dell'Agenzia delle Entrate locale, era questa: l'architetto risultava evasore totale dal 1998 al 2005 in quanto non risultavano pervenute in tutti quegli anni dichiarazioni dei redditi a lui intestate.

Attimo .. attimi... di panico, amplificati da quella sorta di rifiuto che generalmente colpisce chi lavora e poco vuole avere a che spartire con le questioni burocratiche e fiscali, e che proprio per questo motivo affida in toto tali incombenze a un commercialista. La commercialista! Ecco chi chiamare: tempo qualche minuto e l'arcano mistero è stato spiegato. Anche se della spiegazione c'è da sorprendersi più che dell'atto notificato.

Ecco quanto emerso dalla verifica effettuata dalla commercialista insieme all'addetto dell'Agenzia delle Entrate locale che aveva prontamente firmato la cartella esattoriale:

• dal 1996 è possibile inviare le dichiarazioni dei redditi in via telematica, appoggiandosi a consulenti abilitati che utilizzano una apposita chiave crittografica (smart card)
• le dichiarazioni dei redditi telematiche arrivano direttamente all'Agenzia delle Entrate di Roma senza passare per quelle locali successivamente la sede di Roma invia a sua volta alle Agenzie periferiche i files di competenza
• questi files non possono essere letti dalle Agenzie periferiche se non in presenza del consulente che ha provveduto all'invio perchè per decrittografarli occorre la chiave di cui sopra
• a parte questo dettaglio, pare che l'Agenzia delle Entrate di Roma sia in ritardo con l'invio alle sedi periferiche più o meno dal 1998
• in conseguenza di ciò i contribuenti risultano evasori dal 1998 per le loro Agenzie locali e se si ha la fortuna di capitare nel campione che periodicamente viene verificato si ha la possibilità di vivere questa magnifica esperienza kafkiana.

Per risolvere la questione la commercialista dovrà presentarsi all'Agenzia locale con la sua chiave e tutti i files delle dichiarazioni di cui nell'atto notificato in modo che il funzionario possa verbalizzarne l'esistenza e la corretta trasmissione all'Agenzia di Roma. Questo ovviamente in quanto non è stato possibile preventivamente (evitando la spesa di realizzazione e invio della cartella esattoriale) effettuare una verifica diretta tra sede periferica e sede centrale. Non è stato possibile, non sarà possibile, o non ci ha pensato nessuno?

Il tutto nello spirito di trasparenza, velocità e semplificazione dei rapporti Fisco-Contribuente che hanno caratterizzato le relative riforme dal 1996 in poi.
Viene da chiedersi, alla luce delle belle notizie degli ultimi giorni relative alle maggiori entrate del primo semestre 2006 ottenute con la lotta all'evasione fiscale, se non si stia festeggiando troppo presto ...
